TERMS & CONDITIONS | PARTICIPATION WAIVER | PRIVACY POLICY

PRIVATE SESSION CANCELLATION POLICY 

Private sessions (individual and pack purchases) are non-refundable. Once you have booked your session(s) you may cancel up to 24 hours before the time and date of the session and the session will be placed back on file for you to use another time. For cancellations that occur inside the 24 hour period, Lisa Messina Movement retains 100% of the total payment. Private sessions are transferable to another person with written permission.

THE PROCESS CANCELLATION POLICY

A deposit of 50% must be made to secure your space in The Process. Your deposit is non-refundable. Final payment is taken 1 week prior to the start date of your program. Once the program begins the full price is non-refundable. Full cancellation terms for specific start dates can be found HERE.

ONLINE LIVE CLASSES CANCELLATION POLICY

Class packs and drop-in class purchases are non-refundable. They are transferable to another person with your written permission. Classes cancelled up to 12 hours prior to the event will return to your profile to be used again for booking.

ON DEMAND MEMBERSHIP POLICY

Membership payments are non-refundable. You may cancel your membership at anytime.

WANDER THE RESORT CANCELLATION POLICY

All paymAll payments and cancellations will be made through Wander the Resort. Please contact our Reception team at 613-902-6650 or email hello@wandertheresort.com for more information. Reception is open daily 8am - 10pm.

A $750.00 deposit is required to book your spot. The remaining balance is due 7 days in advance of the event arrival date.


We are happy to offer a full refund providing cancellations are made by February 15th, 2023 at 3 p.m. EST. If cancellations are made after the cancellation date deposits are non-refundable but transferable. Bookings will need to be transferred by March 15, 2023.

If a cancellation is not made in accordance with our policy, you will be charged in full for your original booking.

PARTICIPATION WAIVER

By interacting with this website and engaging in the activities provided, I am agreeing to participate in fitness, movement, and/or coaching activities (“Activities”) I have signed up for, such as Barre, Functional Range Conditioning®, pilates, yoga rope wall, relational somatic counselling, SUP yoga, and yoga (such as philosophy, asana, pranayama, restorative, chanting, nidra, and meditation), offered by Lisa Messina o/a Lisa Messina Movement (“Lisa”) as private sessions or group classes, whether in-person or online.

I understand and agree that the Activities:

- can be physically, emotionally, and mentally intense, potentially dangerous, may require exertion, and that the possibility of injury to myself and others does exist;
- can be dangerous if not conducted by myself or others in accordance with the safety rules and guidelines established by Lisa, and the instructions of Lisa’s service providers who are leading and supervising particular Activities;
- may involve risks causing mental, emotional, and physical injury such as cuts and bruises, broken bones, heart attack, stroke, and other risks to health up to and including death, as well as damage or loss of personal property (“Risks”), such as those resulting from:

  • malfunction of equipment;

  • tripping, slipping, or falling;

  • overexertion;

  • contact with or immersion in water;

  • physical contact with other participants, Lisa personnel or service providers, equipment, and apparatus;

  • high intensity training and rapid physical movements;

  • imperfect supervision or instruction by Lisa or her service providers; and

  • loss or damage of personal property.

I agree to follow the rules, regulations and guidelines set out verbally or in writing by Lisa and her service providers for the Activities, and use best efforts to avoid injury to myself or others. I am fully aware of the Risks and confirm that I am physically and mentally able to participate in the Activities. I will notify the Activity coordinator in advance of any condition that may affect my ability to participate in an Activity safely. I confirm that I am voluntarily assuming the risk of participating in the Activities, and that Lisa is not responsible for the cost of any medical attention I may require as a result.

HEALTH CONDITIONS

I will disclose on this form all pre-existing health conditions and other restrictions which may affect my ability to participate in the Activities. I will bring and keep with me, and have listed below any medications or devices (such as inhalers, Epipens, or alert bracelets) which are vital to my health.

I declare that I am in good health and do not suffer from any condition which could be worsened by my participation in the Activities.

RELEASE & LIMITATION OF LIABILITY
In consideration of the registration fee paid by me to Lisa and my participation in the Activities, I release and forever discharge Lisa, her employees, contractors, agents, and representatives, and her landlords and owners of the Activity venue and their respective directors and officers (the “Team”) from any and all claims and liabilities whatsoever which I may have now or in the future may arise against them arising from or related to my participation in the Activities or the Risks. I will indemnify the Team against any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities arising from or related to my participation in the Activities, or the Risks. This release does not apply to claims or liabilities arising directly from the gross negligence, intentional misconduct, or illegal acts of the Team, in which case the liability of the Team will be limited to direct damages only. This release will be binding on my estate, heirs, and representatives.

GENERAL
I understand that I am waiving certain legal rights by signing this release in consideration of participating in the Activities. I confirm that this is a legally binding contract. I have been provided with the opportunity to consult a lawyer before signing it, if I have any questions or concerns. This release will be interpreted in accordance with the laws of the Province of Ontario, and the laws of Canada as applicable therein. No other representations, statements or inducements, apart from those contained in this release have been made to me. By participating, I acknowledge and represent that I am of sound mind, have read the release, understand it, and am participating voluntarily

This section explains how we use your information and the legal basis on which we use it.

For the performance of our commitment with you

We use your information when you enter formal relationships with us (for example join us at a retreat or seminar) so we can:

  • Process your order, take payment, and provide you with any customer support.

For our legitimate business interests

  • To conduct market research and analysis which helps improve and customise our products and services

  • For our marketing purposes, unless your consent is required for such marketing (see section below).

  • To send you customer service emails including booking confirmations and reminders.

  • To prevent or detect unlawful behaviour, to protect or enforce our legal rights or as otherwise permitted by law. For example, making sure your spot is secured at a retreat. As such, we may use your information to prevent touting, misuse of our intellectual property, fraud, or other crimes.

  • To create a profile about you to help us personalise our services to you. For example, if you purchase tickets to an add-on event and you have consented to our marketing, we will inform you about other events we think you might be interested in.

YOUR RIGHTS AND CHOICES

Where you have given us your consent, you can withdraw it by doing the following:

  • To stop receiving our marketing you can change your preferences and unsubscribe from any emails we send your way

  • To opt out of the use of cookies and tracking tools

  • To opt out of location tracking and push notifications, you can change the settings on your device or keep your location off. To stop web push notifications, you will need to use your browser settings.

You also have rights over how your personal information is used including:

  • The right to object to our processing of your data.

LOOKING AFTER YOUR INFORMATION

We have security measures in place to protect your information. The security measures we use will depend on the type of information collected.

We only keep your information for as long as required to provide you with the services you request, for the purposes outlined in this policy and for any legal purposes for which we are obliged to keep the information. We will securely delete your information when it is no longer required for these purposes, in line with our company policies.
